Jeweller’s compensation argument finds favour in court

Cumbrian jeweller received insurance payout for smashed window but argued that irresponsible incident still cost it in terms of policy excess and higher premiums

A Cumbrian jeweller has won compensation from a reveller who broke a window in a fit of anger after convincing a judge that it would still be worse off financially even though it received an insurance pay-out.

27-year-old Max Murdoch caused more than £5,000 damage when he threw a glass from a pub across the street, smashing a large display window at H.Hogarth Jewellers in Kendal.  

According to The Westmorland Gazette, the entire window had to be replaced, while repairs were carried out to the security system, lighting system and window frame.

Although H.Hogarth was successful in an insurance claim, it sought recompense in relation to a £750 policy excess and likely future payment increases due to the loss of its no-claims bonus.   

Judge Barker concluded that activating the jail term would be “disproportionate and unnecessary”.

Mr Murdoch was spared jail for the incident but ordered to pay £2,250 compensation and complete a 12-month community order.

H.Hogarth Jewellers is a fourth generation independent family jewellers that was established in 1879.
